3-4-1 – ESTABLISHMENT AND PURPOSE.

A volunteer fire department is hereby established to prevent and extinguish fires
and to protect lives and property against fires, to promote fire prevention and
fire safety, and to answer all emergency calls for which there is no other established
agency. (Code of Iowa, Sec. 364.16)

3-4-2 – VOLUNTEER FIRE FIGHTERS.

Residents of Fertile, Iowa, at least age eighteen (18) shall be appointed to serve
as a volunteer fire fighter. Prior to appointment of youth younger than (18) will be designated as volunteer cadets, and will have restricted duty as defined by the Fire Department;s By-Laws. Prior to appointment as a volunteer fire fighter, a volunteer fire fighter must pass a medical physical examination. (Code of Iowa, Sec. 362.10)

3-4-3 – MEMBERSHIP QUALIFICATIONS.

In no case shall any person be; recruited, selected, or appointed as a member of
the department unless such person:

  1. Age. Is at least eighteen (18) years of age.
  2. Driver’s License. Has a current active Iowa driver’s license. Copies shall be provided
    to the Fire Chief and the City Clerk. In the event that a volunteer fire fighter
    shall have his\her driver’s license suspended or revoked, he\she shall immediately
    notify the Fire Chief of the suspension or revocation and shall not operate, or
    be directed to operate any equipment that requires a valid driver’s license as required
    by the Code of Iowa. Any violation of this requirement shall be cause for removal
    from the department. If the Fire Chief knowingly violates this requirement, the Council
    may remove the Chief from this Chief position.

3-4-4 – TRAINING.

All members of the department shall attend and actively participate in regular or
special training drills or programs as directed by the chief. Each new fire fighter
after October 1, 1994, shall complete within two years the training classes sponsored
by the Iowa State Fire fighters Association to be eligible to sit for testing to
be certified, and shall meet any training as may be required by the State Fire Marshall.

3-4-5 – FIRE FIGHTER’S DUTIES.

When called by the Chief, all fire fighters shall report for duty immediately in
the manner directed by the Chief. They shall be subject to call at any time. They
shall obey strictly the commands of any other fire fighter who has been appointed
by the Chief to be in command temporarily. Fire fighters shall report for training
as ordered by the Chief. (Code of Iowa, Sec. 372.13(4))

3-4-6 – WORKER’S COMPENSATION AND HOSPITALIZATION INSURANCE.

The City Council shall contract to insure the City against liability for worker’s
compensation and against statutory liability for the costs of hospitalization, nursing,
and medical attention for volunteer fire fighters. All volunteer fire fighters shall
be covered by the contract.

3-4-7 – LIABILITY INSURANCE.

The City Council shall contract to insure against liability of the City or members
of the department for injuries, death or property damage arising out of and resulting
from the performance of departmental duties.

3-4-8 – FIRES OUTSIDE CITY LIMITS.

The department shall answer calls to fires and other emergencies outside the City
limits if the Fire Chief determines that such emergency exists and that such action
will not endanger persons and property within the City limits. (Code of Iowa, Sec.
364.16)

3-4-9 – MUTUAL AID.

The department shall answer calls to fire and other emergencies with other departments
as outlined in mutual aid agreements entered into. All mutual aid agreements shall
be in writing and kept on file with the City Clerk, and the Fire Department.
